Michelle Carter's Defense Ask Judge To Dismiss Case

The involuntary manslaughter trial of Michelle Carter, accused of urging her boyfriend Conrad Roy III to commit suicide on July 12, 2014, hinges on a series of text messages she sent the MA teenager in the days.

"Are you gonna do it tonight?"

He can either allow the defense motion and find Carter not guilty, or allow the trial to proceed with the defense portion of the case.

Carter: "I feel like such an idiot. because you didn't even do anything". You said you were going to the woods to do it ...

"She turned [their conversations] into: 'I love you". "You're right. I don't have it in me".

Roy's body was found July 13, 2014, in the parking lot of a Kmart in Fairhaven, almost 40 miles from his home.

One text message read in court showed that Carter wrote to Roy, "all you have to do is turn on the generator and you will be free and happy". A normal amount is 1-3%, and 3-5% for smokers. A medical examiner ruled his death a suicide by carbon monoxide poisoning. Lower levels would cause dizziness and confusion.

On the day he died, she went to the beach with Conrad and his sisters, Roy testified. After about 20 minutes, a person is dead. He says Roy had a history of depression, had previously attempted suicide and was entirely responsible for his own death.

The troopers and the pathologist who conducted the autopsy on Roy's body also testified on Thursday.

Roy, 18, spoke in the video about how anxious he felt at the time. Carter eventually became annoyed that Roy hadn't followed through.

Defendant Michelle Carter adjusts her hair while her legal team approaches the bench for a sidebar discussion at Taunton District Court in Taunton, Mass., in Taunton, Mass., Thursday, June 8, 2017. He also said Carter had likely deleted some messages from her phone she had sent to Roy.

"It is not a homicide", lawyers for Carter said.

"It was his choice", Cataldo told the judge in his opening statement. "She was reckless your honor, and she caused his death".

Carter texted that she "told him to get back in".

Meanwhile, Labour leader Jeremy Corbyn said the early results showed May had lost her mandate and called for her to resign. Some Brexit advocates want the U.K.to reject terms offered by the EU and possibly leave the union without an agreement.

What was apparently working was Roy's attempt to take his life by inhaling the deadly gas in his black Ford F-250.

Throughout the week, prosecutors presented numerous jarring text message conversations between Carter and Roy in which Carter appeared to repeatedly encourage Roy to take his own life despite his apparent hesitation.

"How bad do you want it because if you want it bad, you should succeed", she said to him. "Because he said he was getting that and some other tools at the store".

Carter texted a classmate in September 2014, "I could've stopped him".

Another message to her friend, Alexandra Eitheir, stated: "I was on the phone talking to him when he killed himself".

It did not stop with text messages, Ms Flynn said. "I'm alone all the time". Roy: I still haven't left yet, ha ha Carter: Why? Carter had tried to help Roy by sending information on hospitals and mental health services, they said. I'm like famous now haha.

"I'm too scared", Roy wrote. I heard moaning. I stayed on the phone for like 20 minutes and that's all I heard.

The prosecution rested Thursday after playing two videos found on Conrad Roy's computer he had made about a month before his death in which he explained his inner turmoil.

"You can't think about it, you just have to do it".

But Mr Cataldo reminded the judge, who will be determining the verdict after Ms Carter opted to forgo a jury trial, that MA is one of about 10 states that do not criminalise assisted suicide. "Telling someone it's OK to kill himself gives them the power to do it".

But after he began taking medication and went to counseling, he seemed much better, Lynn Roy said.

He described Ms Carter as a vulnerable teenager, too, saying she had suffered from an eating disorder, had been treated in a psychiatric hospital and was impaired by the side effects of an antidepressant. She later claimed that she listened on her cellphone as he died.
