A letter from the Justice Department released Thursday said officials believe NY is violating a law requiring cooperation on immigration enforcement - one of four cities put on notice they were out of compliance. That law says local governments "may not prohibit, or in any way restrict" the delivery of information about "the citizenship or immigration status, lawful or unlawful, of any individual" to federal immigration authorities.

"Jurisdictions that adopt so-called "sanctuary policies" also adopt the view that the protection of criminal aliens is more important than the protection of law-abiding citizens and of the rule of law", Attorney General Jeff Sessions said in a statement.

Similar letters went to Chicago and Cook County where that city is located, Philadelphia and New Orleans telling them they're out of compliance. Immigration is a federal matter.

The determinations came after the Justice Department earlier in the year had asked several local jurisdictions to detail their compliance with the law in order to make a determination about their eligibility for certain federal grants.

News reports that Chicago, New York, Philadelphia and New Orleans have "laws, policies or practices" that violate a federal statute requiring that local governments comply with federal immigration officials in deporting suspected undocumented immigrants in local jails, according to a Justice Department news release.

"Chicago will not be blackmailed into changing our values, and we are and will remain a welcoming city", Mayor Rahm Emanuel said at a press conference announcing that suit.

The letters don't say what will happen if the cities don't comply. It determined Milwaukee County, Wisconsin, and CT to be in compliance.

The DOJ also cleared four jurisdictions of failing to comply with Section 8 U.S.C. s. 1373: Milwaukee County, WI; the state of Connecticut; Clark County, NV; and Miami-Dade County, FL.

The jurisdictions have until October 27 to show they don't have any codes or policies preventing local law enforcement from cooperating with federal immigration authorities.

The city has two weeks to write back to the Department. A federal judge sided with the city last month and issued a preliminary injunction barring the USA government from denying public-safety grants.

In April, a presidential executive order that would have cut off funds to sanctuary cities was stymied by a judge's order.

The Kenney administration has until October 27 to submit a response to the DOJ assessment before a final determination is made, Hanson wrote.

The city has said its policies are legal, and vowed to sue if money is actually taken away.
